1. Acceptance of Terms

By downloading, installing, accessing, or using SELION.AI in any capacity, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must immediately discontinue use of the application.

These Terms apply to all users, including free tier users and premium subscribers, and govern your access to all features, services, and functionality provided by SELION.AI.

2. Description of Service

SELION.AI is a premium, AI-powered wardrobe management platform designed to revolutionize your fashion experience. Our comprehensive suite of features includes:

3. Account Registration and Security

• Authentication: You must authenticate using a valid Google account. We utilize industry-standard OAuth 2.0 protocols for secure access.
• Account Security: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account.
• Accurate Information: You agree to provide accurate, current, and complete information during registration and to promptly update your information to maintain its accuracy.
• Age Requirements: You must be at least 13 years of age to create an account and use SELION.AI. Users under 18 should obtain parental or guardian consent.
• Account Integrity: You may not share, transfer, or sell your account to third parties. Each account is for individual use only.
• Unauthorized Access: You must immediately notify us of any unauthorized access or security breaches at [email protected].

5. Billing, Renewals, and Cancellation

Transparent billing practices designed for your convenience:

• Payment Processing: All subscriptions are securely processed through Google Play's trusted billing infrastructure with PCI DSS compliance.
• Automatic Renewal: Subscriptions automatically renew at the end of each billing cycle unless cancelled at least 24 hours before the renewal date. This ensures uninterrupted premium access.
• Easy Cancellation: Cancel your subscription anytime without penalties through Google Play Store → Subscriptions. Your premium features remain active until the end of your paid period.
• Refund Policy: Due to the digital nature of our service, we do not offer refunds for partial subscription periods. You retain access through the end of your billing cycle.
• Free Trials: If a free trial is offered, it will automatically convert to a paid subscription unless cancelled before the trial period ends. You will be notified before any charges occur.
• Price Changes: We reserve the right to modify subscription pricing with 30 days advance notice. Existing subscribers maintain their current rate for the remainder of their billing cycle.
• Payment Failures: If payment fails, premium features may be suspended until billing is resolved. We will notify you and provide a grace period to update payment information.

6. User Content and Intellectual Property

Your content belongs to you, and we respect your ownership rights:

• Content Ownership: You retain full ownership of all photos, images, and content you upload to SELION.AI. We claim no ownership over your personal content.
• License Grant: By uploading content, you grant SELION.AI a limited, non-exclusive, worldwide, royalty-free license to use, store, process, and display your content solely for the purpose of providing and improving our services.
• Content Rights: You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions to upload and share your content, and that such content does not violate any third-party rights.
• Content Restrictions: You agree not to upload content that is illegal, harmful, threatening, abusive, defamatory, pornographic, obscene, discriminatory, or otherwise objectionable.
• Content Moderation: We reserve the right to review, monitor, and remove content that violates these Terms or applicable laws, though we are not obligated to do so.
• Backup Responsibility: While we maintain robust backup systems, you remain responsible for keeping independent copies of your important content.

7. Acceptable Use Policy

To maintain a premium, secure platform for all users, you agree to comply with the following acceptable use standards:

You agree NOT to:

• Illegal Activities: Use the service for any unlawful purpose or in violation of any local, state, national, or international law.
• Intellectual Property Infringement: Upload, share, or distribute content that infringes on copyrights, trademarks, patents, or other intellectual property rights.
• Security Violations: Attempt to reverse engineer, decompile, disassemble, hack, or compromise the security of the application or its infrastructure.
• Automated Access: Use bots, scrapers, crawlers, or automated systems to access the service without explicit written permission.
• Account Sharing: Share, transfer, rent, or sell your account credentials to third parties.
• Harmful Content: Upload inappropriate, offensive, harmful, threatening, sexually explicit, or discriminatory content.
• Service Abuse: Overload, spam, or interfere with the proper functioning of the service or other users' experience.
• Impersonation: Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
• Data Mining: Extract, harvest, or collect user data or content without authorization.

Violations of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.

8. AI-Generated Content and Disclaimers

Our AI technology represents cutting-edge innovation, with the following important considerations:

• Generated Content Nature: AI try-on results are computer-generated visualizations created using advanced machine learning algorithms. They are artistic representations and may not perfectly replicate real-world appearance.
• No Accuracy Guarantee: While we strive for photorealistic results, we do not guarantee pixel-perfect accuracy, color matching, or exact representation of how clothing will appear in reality.
• Personal Use License: AI-generated images are provided for your personal, non-commercial use only. You may not use them for commercial purposes, resale, or distribution without explicit written permission.
• Responsible Use: You agree not to use AI features to create misleading, deceptive, harmful, defamatory, or inappropriate content.
• Technology Limitations: AI technology is continuously evolving. Results may vary based on image quality, lighting, clothing complexity, and other factors.
• No Endorsements: AI-generated images do not constitute endorsements of products, brands, or retailers.

9. SELION.AI Intellectual Property

SELION.AI and all associated intellectual property are protected by international copyright, trademark, and intellectual property laws:

• Proprietary Rights: The SELION.AI application, including its design, user interface, features, algorithms, source code, graphics, logos, and all related technology, is proprietary and owned by SELION.AI or its licensors.
• Trademarks: SELION.AI, our logo, and associated marks are trademarks of SELION.AI. You may not use our trademarks without explicit written permission.
• Prohibited Actions: You may not copy, modify, reproduce, reverse engineer, decompile, distribute, sublicense, rent, lease, or create derivative works based on SELION.AI or its components.
• Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use SELION.AI for personal, non-commercial purposes in accordance with these Terms.
• Reservation of Rights: All rights not expressly granted herein are reserved by SELION.AI.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
• WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.
• WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR MEET YOUR SPECIFIC REQUIREMENTS.
• WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT, INCLUDING AI-GENERATED IMAGES.
• YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. ANY CONTENT DOWNLOADED OR OBTAINED THROUGH THE SERVICE IS AT YOUR OWN DISCRETION AND RISK.

Some jurisdictions do not allow disclaimers of implied warranties, so some of the above disclaimers may not apply to you.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• SELION.AI, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
• THIS INCLUDES DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
• OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO SELION.AI IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
• THESE LIMITATIONS APPLY WHETHER THE LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.

Some jurisdictions do not allow limitations on liability, so these limitations may not apply to you.

12. Account Termination and Suspension

Account termination rights and procedures:

• Voluntary Termination: You may delete your account at any time through the app (Profile → Settings → Delete Account). This action is permanent and irreversible.
• Termination for Cause: We reserve the right to suspend or terminate your account immediately, without prior notice or liability, if you violate these Terms or engage in fraudulent, abusive, or illegal activity.
• Data Deletion: Upon termination, your data will be permanently deleted within 30 days in accordance with our Privacy Policy. Backup copies are retained for disaster recovery for up to 30 days.
• No Refunds: Termination for violations does not entitle you to any refund of subscription fees.
• Survival: Provisions regarding intellectual property, disclaimers, limitations of liability, and indemnification survive termination.

13. Modifications to Terms

We reserve the right to modify these Terms of Service at any time:

• Notification: Material changes will be communicated through in-app notifications, email, or a notice on our website at least 30 days before taking effect.
• Acceptance: Continued use of SELION.AI after modifications take effect constitutes your acceptance of the revised Terms.
• Rejection: If you do not agree to modified Terms, you must discontinue use and may delete your account.
• Version Control: The "Last updated" date at the top of this document indicates the most recent version.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with applicable laws:

• Governing Law: These Terms shall be governed by the laws of the jurisdiction where SELION.AI operates, without regard to conflict of law principles.
• Dispute Resolution: Any disputes arising from these Terms or your use of SELION.AI shall first be resolved through good-faith negotiation.
• Jurisdiction: You agree to submit to the personal and exclusive jurisdiction of the courts located within our operational jurisdiction.
• Class Action Waiver: You agree to resolve disputes individually and waive the right to participate in class actions or class arbitrations.

15. Indemnification

You agree to indemnify, defend, and hold harmless SELION.AI, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property or privacy rights
• Content you upload or share through the service

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to reflect the parties' intention to the maximum extent permitted by law.

17. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and SELION.AI regarding your use of the service, superseding any prior agreements or understandings.
